Neither is right, but Vanessa was over 18 when these pictures were released.
Also, Vanessa took them for a boyfriend of sorts, which is a private matter (until they were released anyway) while Miley is looking for attention and posting them herself.
Miley makes this whole borderline naked picture show thing pretty often too, while Vanessa has only really had this one isolated public incident.
